'Not the other way around': SolGen says ICC should give drug war findings to PH

MANILA -- The International Criminal Court (ICC) should submit its drug war findings to the Philippine government and let domestic courts tackle the case, Solicitor General Menardo Guevarra said on Tuesday.

The Philippines has not responded to the ICC's request to aid in its investigation into the drug war of former President Rodrigo Duterte because the country is no longer obliged to help the international investigating agency since it pulled out its membership, Guevarra told state television PTV.

"Kung 'yan ang mandato ninyo na mag-imbestiga, mag imbestiga kayo. Ang sinasabi lang ng Philippine government, wag niyo na kami isama pa diyan, wag niyo na kami asahang tumulong sa imbestigasyon ninyo kasi kami nagiimbestiga on our own," he said.

"Kung gusto ninyo na makatulong, kayo ang sumuporta sa investigation ng Philippine government, hindi 'yung kami ang tutulong sa inyo," he said.

"Baliktarin natin: Kung ano ang mayroon kayo, ibigay ninyo sa Philippine government para kami ang makapag prosecute kung sino ang dapat i-prosecute. Not the other way around," he added.

The ICC has been investigating possible human rights violations committed under the Duterte administration's war on drugs, which saw thousands of drug suspects — including minors — brutally killed either by police or unknown assailants.

The ICC has asked the Philippine government — now under the administration of President Ferdinand Marcos Jr. — to coordinate the interviews of 5 key personalities either by helping bring them to the Hague in the Netherlands or by conducting the interrogations on behalf of the ICC, Guevarra said.

"Hindi kumibo, hindi nag-react ang Philippine government sa request na yun," he said.

"Kung gusto ninyo [ICC], magpatuloy kayo kung ano gusto ninyong gawin on your own pero wag niyo na hingin ang tulong ng Philippine government kasi we have our own system of government here," he said.

Last month, former Sen. Leila de Lima said that self-confessed Davao Death Squad (DDS) hitmen Arturo Lascañas and Edgar Matobato are now under the protective custody of the ICC.

Earlier reports also claimed that Matobato and his family were able to leave the Philippines to an undisclosed foreign destination using fake identities and travel documents.
