House OKs bill for SSS and PhilHealth membership, other benefits for trike sector

MANILA — The House of Representatives has approved a proposed measure defining the rights and benefits of tricycle drivers and operators, which include access to medical care and streamlined registration processes.

During the House plenary session on Wednesday, 180 members unanimously voted to approve House Bill 11227 or the proposed Magna Carta for Tricycle Drivers and Operators on third and final reading.

If passed into law, workers in the tricycle sector will have the right to access to medical care services and insurance, safe working conditions, and to protection from any act of interference, coercion, extortion, and bureaucratic red tape in the exercise of these rights.

MANDATORY SSS AND PHILHEALTH MEMEBRSHIP

The bill provides for the mandatory membership in the Social Security System (SSS) and PhilHealth membership.

It tasks PhilHealth with working with tricycle sector organizations, the Department of Social Welfare and Development, and other concerned government agencies and local government units to identify drivers and operators entitled to government subsidy on premium contributions.

EASIER REGISTRATION

The bill, if it becomes a law, will require the implementation of a simple system and procedure for the registration and issuance of Motorized Tricycle Operators Permit, which will have a five-year validity.

MTOP fees will initially be capped at P1,000, with the Department of Transportation authorized to increase fees at no more than 10% of the current fee.

It also requires government agencies and offices to include the rights and concerns of the tricycle sector in their plans and programs.

The bill also favors the issuance of tickets for violations, with impoundingof tricycle units only allowed in the following cases:

  • When used in the commission of a crime
  • If operated without, with an expired or with a fictitious MTOP
  • If the unit is not roadworthy or is non-compliant with the Philippine Clean Air Act of 1999
  • If the driver has no driver’s license

The bill also mandates all concerned national government agencies, government financial institutions, and local government units to include in their plans and programs efforts that are supportive of the rights and other concerns of the tricycle sector.

WHERE WILL TRICYCLES BE ALLOWED TO OPERATE?

For safety reasons, the bill proposes that tricycles be prohibited no national highways used by four-wheeled vehicles heavier than four tons and where normal speeds are higher than 40 kilometers per hour.

Local legislative councils can provide exceptions, through an ordinance, if no public transportation options are available on that route.  

Tricycles are a common transportation option and source of livelihood in communities and areas far from main roads or where jeepneys and buses do not operate.
