VIVA Artists Agency files lawsuit vs Nadine Lustre

VIVA Artists Agency (VAA) has filed a case against actress Nadine Lustre, as reported by ABS-CBN News' MJ Felipe through a series of tweets on Friday evening, December 11.

The lawsuit was filed before the Quezon City Regional Trial Court.

MJ, in his tweets, reported, "BREAKING NEWS: Viva Artists Agency filed a lawsuit against Nadine Lustre before QCRTC earlier today. According to a statement sent by Viva, the lawsuit was filed because early this year, Nadine violated her valid and existing 'agency and management contract'. (1)."

"(2) Lustre contracted independently with advertisers, promoters, and other third parties, disregarding her exclusive contract with Viva.

The lawsuit filed seeks to stop Nadine from continuously violating her 'agency and management contract' with VAA."

"(3) Atty Chino Roxas, VAA counsel: 'Ms. Lustre should honor & respect the sanctity of contracts & that third parties are put on notice that any direct dealings w/ Ms. Lustre for her services as a performing artist or endorser shall be in violation of Ms. Lustre’s contract w/ VAA,” his third tweet said.

It was reported in January of this year that Nadine left VAA.

A press statement by Kapunan and Castillo Law Offices dated January 24 said, “For the information of the public, Nadine Lustre is no longer a talent of Viva Artists Agency. Consistent with her rights under the Civil Code of the Philippines, specifically Article 1920, she has decided to terminate her agency contract with Viva.

“As of now, Nadine is self-managed and will continue to be so indefinitely. She shall directly manage her affairs from now on, and bookings and inquiries may be directly addressed to her.”

Meanwhile, VAA also released a statement, saying that “Nadine remains an exclusive artist of VIVA.”

“Contrary to the press statement, Nadine [Lustre] remains an exclusive artist of Viva as she has a valid and subsisting management contract. Under the law, Nadine cannot unilaterally withdraw from her contract with VIVA.

“Any dealings or professional engagements entered into by Nadine, without consent or approval of VIVA, constitutes breach of contract.

“VAA will initiate appropriate legal action against Nadine and/or third parties that directly deal with Nadine in contravention of VIVA’s management contract.”
