MANILA — Joey Chua Uy, the winner in Manila’s 6th District congressional race, on Friday said he is a Filipino after a Commission on Elections (Comelec) resolution voiding his certificate of candidacy (COC) due to alleged misrepresentation.

In a statement, Chua Uy said he was born in Sta. Mesa, Manila to a mother who is natural-born Filipino and a father who is a naturalized Filipino. 

“Kung ang inyong ina ay natural-born at ang Pilipinas ang iyong lupang sinilangan, 'di ba, natural-born Filipino. Ako po ay Pilipino,” he said in a statement. 

“Lumaki, nag-aral, naninirahan, nagsilbi at patuloy akong nagsisilbi sa aking mahal na lungsod ng Maynila bilang konsehal nang ilang termino mula pa noong 2004,” he added.

Chua Uy said the residents who voted for him have already spoken and already chose their representative through a “free and democratic” election.

“Sana naman po ay mapakinggan ang kanilang boses… Ang boses ng taumbayan, siya ring tinig ng kalangitan,” he said.

The Comelec 2nd Division has ruled that Chua Uy was not a natural-born citizen but rather a “naturalized citizen” contrary to his certificate of candidacy (COC).

This stemmed from Rep. Benny Abante’s petition questioning Chua Uy’s citizenship.

The Comelec division said when Chua Uy was born on March 15, 1962, his father was a Chinese citizen “who became a naturalized Filipino on 28 August 1967.” His mother, meanwhile, was "a Filipino citizen prior to her marriage in January 1944” to his father who is a Chinese national.

Because of this, it said Chua Uy “made a false declaration in his COC” and therefore he made a “material misrepresentation” under the Omnibus Election Code. 

He is now considered a “non-candidate” and his COC is void ab initio, according to the poll body.

This paved the way for Abante, who has been in position since 2019, to be declared "as the duly elected Member, House of Representatives, 6th District of the City of Manila."

Comelec Chairman George Garcia said since the decision is not yet final and executory, it means Chua Uy’s proclamation still has an effect.
