Philippines confident US will respect gov't decision on Duterte's ICC arrest

 MANILA — Malacañang on Monday said it believed that the United States would respect the "sovereign prerogative" of the Philippine government in carrying out the recent arrest of former President Rodrigo Duterte on an International Criminal Court warrant.

Palace Press Officer Claire Castro made the statement as she responded to Sen. Bato Dela Rosa, who recently called on US President Donald Trump to sanction those who assisted Duterte’s turnover to the ICC. 

Dela Rosa noted Trump’s Executive Order signed last February, which authorizes economic and travel sanctions against people who work on ICC investigations of US citizens or allies such as Israel.

The EO said the United States “unequivocally opposes and expects” its allies to “oppose any ICC actions against the United States, Israel, or any other ally of the United States that has not consented to ICC jurisdiction.”

Castro said that while the Philippines might be among the list of US allies possibly covered by Trump’s executive order, she believes that the US still recognizes the country’s prerogative.

She cited a portion of the EO which states: "The United States remains committed to the accountability and to the peaceful cultivation of international order at the ICC. And the parties to the Rome Statute must expect the decisions of the United states and another countries not to subject their personnel to the ICC’s jurisdiction consistent with their respective sovereign prerogatives."

“So, ibig sabihin po nito ay iginagalang naman po ng bansang Amerika sa pamamagitan ng Executive Order na ito kung anuman po ang prerogatibo or prerogatives ng bansa na miyembro po ng ally, na tinatawag na ally ng US. So, kung anuman ang naging prerogative ng bansa natin. Ito naman po ay igagalang ng bansang US,” the official said.

Duterte was arrested on March 11 after the Interpol served an arrest warrant issued by the ICC. He was sent to The Hague, Netherlands on the same day.
