SC gives gov’t officials 24 hours to show cause on Duterte habeas petitions

MANILA — The Supreme Court has directed Philippine government officials involved in the arrest of former President Rodrigo Duterte to show cause within 24 hours why the writ of habeas corpus should not be issued.

In a statement, the SC said respondents led by Executive Secretary Lucas Bersamin should show cause within 24 hours “why the peremptory writ of habeas corpus should not issue.”

The SC also said the three habeas corpus petitions filed by Davao City 1st District Representative Paolo Duterte, Davao City Mayor Sebastian Duterte, and Veronica Duterte were consolidated.

Rep. Duterte earlier asked the Supreme Court to order the Philippine government to stop cooperating with the International Criminal Court and the International Criminal Police Organization (Interpol).

The petition was filed at the Supreme Court on Tuesday, the same day the petitions for habeas corpus of Rep. Duterte's siblings Davao City Mayor Sebastian and Kitty Duterte were filed.

Lawyer Harry Roque filed Rep. Duterte's petition for habeas corpus, certiorari and prohibition, with a prayer for temporary restraining order.

Duterte alleged that his father was unlawfully arrested and illegally detained.

The 79-year-old Duterte faces a charge of "the crime against humanity of murder", according to the International Criminal Court, for a crackdown that rights groups estimate killed tens of thousands of mostly poor men, often without proof they were linked to drugs.

Duterte was arrested at Manila's international airport Tuesday after "Interpol Manila received the official copy of the warrant of the arrest from the ICC", the presidential palace said.

An ICC spokesman later confirmed the warrant and said an initial appearance hearing would be scheduled when Duterte was in court custody.
