MANILA (UPDATE) — A Pasay court has ordered the release of detained actress and businesswoman Neri Naig, the Bureau of Jail Management and Penology (BJMP) and her lawyer said Wednesday.

The Regional Trial Court of Pasay City Branch 112 granted Naig's motion to quash the warrant of arrest issued against her, said her lawyer Aureli Sinsuat. 

Miranda was detained in Pasay City Jail on November 27 after a commitment order issued by the same court for violation of the Securities Regulation Code and syndicated estafa.

It was on November 29 when the same court granted Miranda's request for medical evaluation and to be sent to a private hospital.

"Ang paglaya niya na ito, itong release order na ito ay hindi dahil sa piyansa o nakapag piyansa, ito ay dahil sa partially granted ang motion to quash ng kanyang mga abogado specifically doon sa kanyang pagkakaaresto… usually nakikita ang merito ng argumento ng kanyang abogado na valid naman ang kanilang argument na may technicalities sa arrests thay's why nagrant ito, partially grant, and with that comes yung kanyang release," said BJMP Spokesperson JSupt Jayrex Bustinera. 

Miranda was supposed to be brought back into the jail facility today after the 5 day medical furlough.

"With the recent development on her release doon na siya papalayain kung lalabas na cleared siya at ma-proseso ang kanyang paglaya ngayong araw," added Bustinera.

Miranda is well in the hospital, according to the BJMP.

"Siya lang po sa ngayon ang nandoon, of course she was visited by her lawyers para nga sa consultation ng kanilang ano sa progress o development ng kanilang kaso…wala naman tayong any major incident na nareport sa atin," said the BJMP Spokesperson.

Through a statement by Miranda's legal counsel Atty Aureli Sinsuat they "confirm that the Regional Trial Court of Pasay City, Branch 112, has granted our motion to quash the warrant of arrest issued against Neri Miranda."

They added that they "appreciate the Court's decision, which underscores Neri's constitutional right to due process."

"The reinvestigation will provide an opportunity for Neri to respond to the allegations against her. We are hopeful that the reinvestigation will clear Neri of any wrongdoing in the Dermacare/Beyond Skin Care Solutions case," the statement added.

"This development marks an important step toward resolving the matter fairly and justly," it said.

Meanwhile, Atty. Roberto Labe, counsel of the 39 complainants that filed the case against Miranda said they knew this would come. As court records showed that the complaints failed to reach the accused which resulted in the quashal of the arrest warrant.

They were never given a chance to counter, Labe said.

"Dapat po kasi hanggang ngayon pero nakatanggap na po ako ng order kahapon pa so nagprepare na po ako dapat ng aming kontra o comment for opposition pero nagkaroon na ng decision yung judge kahapon, motu propio," Labe said.

Labe added, the court had given 60 days for the complaints to undergo preliminary investigation again.

"Meron pa pong kumokontak sa akin na mga OFW after nito nakita sa TV nakita nila sa inyo nagkaroon ng lakas ng loob nabuhayan na habulin dahil sa kanila palagay di na mahabol dahil nagtatago po yung mga board of directors," Labe added.  

The arraignment is set on January 09 next year on Pasay RTC Branch 112.

Naig was arrested last week over charges of estafa and alleged violation of the Securities Regulation Code.

She was accused of persuading individuals to invest in a skin care company that is not authorized to solicit investments from the public, the Securities and Exchange Commission said.

Naig's camp denied the allegations, saying she was a "victim."
