MANILA - The Department of National Defense is still looking for the records of Senator Antonio Trillanes IV's application for amnesty, its spokesperson Arsenio Andolong said Tuesday.

Andolong said even though the nullification of the amnesty granted to Trillanes has been issued, they have not stopped looking for the documents critical to the matter.

"Walang available copy. Meron niyan somewhere... Noong inisyu ang certification, during that time and day, hindi makita... Hindi ibig sabihin nun na hindi hinahanap," he said in a radio DZMM interview.

(There was no copy available. When the certification, at that time and day, it was missing. That does not mean we are not looking for it.)

Asked what will happen if the documents of Trillanes will be found, Andolong said the senator "can use that to validate his claim that he submitted an application and we're perfectly willing to verify it."

In a proclamation, President Rodrigo Duterte voided the amnesty granted to Trillanes by the previous administration in 2011.

The proclamation said Trillanes failed to file an application for amnesty and did not express admission of guilt. The senator has denied these claims, saying he could not have been granted amnesty, which was concurred by Congress, if he did not file an application.

In a press conference, military spokesman Colonel Edgard Arevalo said since the amnesty was voided, Trillanes is now back to his military status.

Arevalo said proceedings of pending case before the court martial will continue. He said when Trillanes is arrested, he will be under the custody of the Armed Forces.

"The court martial will have to be reconstituted as some members have already retired. In which case the acting chief of staff Lt. Gen. Salvador Melchor Mison Jr. has already instructed the convening of a general court martial," he said.

Trillanes and his Magdalo band of soldiers occupied the Oakwood Hotel in 2003 and the Manila Peninsula Hotel in 2007 to protest alleged corruption under then President Gloria Macapagal-Arroyo.

He was facing trial for non-bailable coup d'état before a Makati court and a separate trial before the military tribunal for mutiny or sedition, among others.
