<p>MANILA -- The Supreme Court has insisted that its ruling on the validity of the Bangsamoro Organic Law and the exclusion of the province of Sulu from the Bangsamoro Autonomous Region in Muslim Mindanao is immediately executory.</p><p>SC spokesperson Atty. Camille Ting reiterated that the BARMM ruling promulgated on September 9, 2024 shall take effect immediately. </p><div><a class="fr-green fr-strong" href="https://news.abs-cbn.com/regions/2024/9/9/sc-sulu-province-not-part-of-bangsamoro-autonomous-region-1654">READ: Sulu Province not part of Bangsamoro Autonomous Region -- SC</a></div><p>&quot;&#x27;Immediately executory&#x27; means that the decision should be fully implemented despite the pending motion for reconsideration,&quot; Ting said.</p><p>The Bangsamoro Government had filed in October twin motions before the Supreme Court to bring back Sulu province to the Bangsamoro region.</p><p>Aside from the twin motions, the Bangsamoro government also included a prayer for the SC to reconsider its decision excluding Sulu from BARMM. </p><p>The Bangsamoro lawyer said the SC decision mentioned it is &quot;immediately executory&quot; and not &quot;final and executory,&quot; paving the way for legal remedies. </p><div><a class="fr-green fr-strong" href="https://news.abs-cbn.com/regions/2024/10/9/bangsamoro-government-asks-sc-to-reconsider-sulus-exclusion-from-barmm-1912">READ: Bangsamoro government asks SC to reconsider Sulu&#x27;s exclusion from BARMM</a></div><p>During the Senate plenary deliberations for the Department of Budget and Management, Senate Finance Committee Chairperson Senator Grace Poe said the government is maintaining the status quo in the region as it is still waiting for the SC decision to become final.</p><p>Poe noted that a <a class="fr-green fr-strong" href="https://news.abs-cbn.com/news/2024/11/8/poe-barmm-status-quo-stays-until-sc-ruling-is-final-1631">motion for reconsideration</a> was filed before the Supreme Court. </p><p>In the unanimous decision of the court, the petition challenging Sulu&#x27;s inclusion in BARMM was partially granted but the challenges to the other aspects of the BOL was denied.</p><p>Even if Sulu rejected the BOL in a plebiscite, it was considered as part of the Autonomous Region in Muslim Mindanao voting as one geographical unit.</p><p>The court said it was wrong to include the province of Sulu as it violated  Article X, Section 18 of the Constitution, which states that only provinces, cities, and geographic areas voting favorably in the plebiscite shall be included in the autonomous region.</p><p>&quot;The decision is immediately executory,&quot; said the SC in its statement on the day the decision was promulgated.</p><p>The Bangsamoro Organic Law provides for &quot;the establishment of BARMM as a political entity and its corresponding basic structure.&quot;</p><p>According to the law enacted on July 27, 2018, the creation of BARMM and determination of its territorial jurisdiction &quot;shall take effect upon the law&#x27;s ratification by majority of votes cast in a plebiscite.&quot;</p><p>Majority of ARMM ratified the law, except Sulu who voted against it. -- <strong>with reports from Paige Javier, ABS-CBN News</strong></p><div><strong>RELATED VIDEO:</strong></div><div><span class="fr-video fr-deletable fr-fvc fr-dvb fr-draggable" contenteditable="false" draggable="true"><iframe width="640" height="360" src="https://www.youtube.com/embed/ymUlPXF8v8M?&amp;wmode=opaque&amp;rel=0" frameBorder="0" allowfullscreen="" class="fr-draggable"></iframe></span><br/></div><div></div>
