LAS VEGAS, Nevada – A 25-year old man pleaded not guilty to 3 counts of reckless driving, 4 counts of driving under the influence, 2 counts of possession of controlled substance and 2 counts of second degree murder resulting in the death of Filipino-American Marcial Escobia Jr.

According to police reports, the 65-year old doctor from Bohol was killed on the morning of October 27, 2019 after Kevin Raspperry ran a red light at high speed crashing his vehicle onto Escobia's.

Escobia's vehicle reportedly went into a roll and struck 3 other vehicles.

Escobia died from his injuries at a hospital. Escobia's wife Nimfa, his passenger at that time, is still in critical condition.

“Very tough…we know that we have to go through the struggle, our pain is definitely permanent but we have to stay strong. For Kevin Raspberry, your decision did not just impact one family. It impacted many more,” said Nimar Escobia, son of Marcial and Nimfa Escobia.

In a report from the District Attorney's Office, Raspperry’s blood alcohol level during the crash was .205, more than 2 and a half times the legal limit. Raspperry also tested positive for methamphetamine, ecstasy and marijuana.

Raspperry reportedly has 2 prior DUI convictions.

The Nevada State Prosecutor representing the Escobia family said the case is moving fast.

“This is a young man who has already been convicted of DUI twice and one of his prior convictions similar to this case it was alleged that he drove a high speed in a red light a drive through a collision. Thankfully, no one was injured and killed. But this is someone who should've learned their lesson and just didn’t and we are dealing with someone who been through the system and didn’t cared to change his behavior,” said State Prosecutor Eric Bauman.

During the hearing, family and friends showed Marcial's pictures to let Rassperry learn the impact of his careless actions.

Raspperry’s bail was originally set for $100,000. But Nevada prosecutors are calling for a much higher bail as Raspperry remains in custody at the Clark Detention Center.

Meanwhile, a GoFundMe page has been set up to help the Escobia family during these difficult times.
