MANILA -- A former president of the Integrated Bar of the Philippines (IBP) on Monday said that Senate resolutions seeking to dismiss the impeachment complaints against Vice President Sara Duterte are baseless and 'very illogical.'

Speaking to DZMM, Domingo Cayosa, a constitutional law expert, stressed that it is the Senate's duty to convene as impeachment court to hear the charges and make judgement.

"Hindi pwedeng i-teknikal yan o yung sinasabing 'functionally dismissed.' Wala 'yang basehan sa konstistusyon at jurisprudence. Very illogical and [it's] contrary to the letters, spirit, and intent of the constitution and their own senate rules on impeachment itong mga resolusyon na ganito," he explained.
"Hindi pwedeng i-teknikal yan o yung sinasabing 'functionally dismissed.' Wala 'yang basehan sa konstistusyon at jurisprudence. Very illogical and [it's] contrary to the letters, spirit, and intent of the constitution and their own senate rules on impeachment itong mga resolusyon na ganito," he explained.
He also expressed dismay over the impeachment delays saying that these 'dribbles' must be minimized.

Meanwhile, Cayosa called on Senate President Francis 'Chiz' Escudero, as the leader of the Congress, to take action with the said impeachment issues.

"Hanggat siya (SP Chiz Escudero) ang Senate President, responsibilidad niya ito bilang lider ng senado. Siya yung nagkukumpas eh.
He has to exercise leadership and convince and compel his fellow senators to obey the mandate of the constitution," said Cayosa.

He believes that the 19th Congress can proceed with the trial until its very last day on June 30, and that it can cross to the 20th to avoid rushed decisions.

Pwede rin kaagad-agad desisyunan nila basta lang marinig ang magkabilang panig that’s minimum baka lang i-avoid nila yung masyadong rush, baka kung anumang desisyon, kukwestyunin na naman yan. Pinabilis ito, there was a denial of due process. So malamang tatawid ito sa 20th congress," Cayosa said.
