MANILA -- The Supreme Court has ordered lawyer Raul Lambino to explain within 10 days why he should not face administrative sanction for “spreading false information” on the arrest of former President Rodrigo Duterte.

The show cause order was made during the April 2 en banc session in Baguio City.

The court noted that in a Facebook Live on March 11, 2025, Lambino falsely claimed that the Supreme Court had issued a temporary restraining order against Duterte's arrest.

“This misinformation caused public confusion and misled the people about the SC’s actions,” SC Spokesperson Atty. Camille Ting said.

Duterte was detained on March 11 and put on a plane to the International Criminal Court in the Netherlands the same day to face a charge of crimes against humanity tied to his drug war, in which thousands of mostly poor were killed.

His lawyer said there was "compelling" argument to throw out the ICC case before it even comes to trial.

"We hope to persuade the judges pre-trial that it (the court) cannot exercise its jurisdiction over the case. There won't be a confirmation-of-charges hearing if the judges rule in our favor," said British-Israeli lawyer Nicholas Kaufman.

A confirmation of charges hearing, where prosecutor and defense first lay out their evidence, is currently scheduled for September 23.

The issue of jurisdiction is key in this case as the Philippines withdrew from the ICC in 2019.

However, when the court issued its arrest warrant for Duterte, it noted that the alleged crimes took place while the country was still an ICC member.
