MANILA — Malacañang on Thursday defended its decision to bar Cabinet officials from attending the investigation of the Senate Committee on Foreign Relations into the recent arrest and transfer of former President Rodrigo Duterte to ICC custody.

In an interview, Executive Secretary Lucas Bersamin said the Palace believes most of the topics that would likely be discussed in the second Senate probe, headed by Sen. Imee Marcos, would come under executive privilege.

“When we learned about the topics, kasi yung invitation ni Sen. Imee was quite specific about the topics. So we had a look at this invitation and we determined that there were many probable or likely topics na covered by those matters that could come under yung executive privilege,” Bersamin said.

Senator Ronald “Bato” Dela Rosa had urged the Senate to subpoena the Cabinet officials following their absence in the Senate investigation Thursday.

President Ferdinand Marcos, Jr., the brother of the senator who initiated the probe, had said that the Philippines' commitment to Interpol was the basis for arresting Duterte, which was the subject of an arrest warrant issued by the International Criminal Court (ICC).

The camp of Duterte however said that the arrest was unlawful, calling it "state kidnapping."
