Officials involved in vote buying? DILG leaves probe to Comelec

MANILA — The Department of the Interior and Local Government (DILG) on Friday said it would let the Commission on Elections (Comelec) handle the investigation on the alleged vote-buying and abuse of state resources involving public officials. 

DILG Assistant Secretary Jesi Lanete said the agency partnered with Comelec’s Committee on Kontra Bigay regarding vote buying, vote-selling, and abuse of state resources. 

“Pagdating sa 158 na total reports regarding sa central monitoring, for our public officers, the Comelec already has a mechanism to investigate and prosecute considering na ito are election offense, the jurisdiction is with Comelec to investigate,” said Lanete. 

“However, if [there is] a probable cause… this will be filed in regular courts handled by the DOJ,” he added.

The DILG official reminded all candidates to strictly comply with Comelec provisions to prevent the abuse of state resources and to ensure that the campaigns in the run-up to the midterm elections would be safe. 

He also said that while there were local government units who applied for exemptions for election spending. 

Section 261 of the Omnibus Election Code imposes a ban on the release of public funds during the election period. 

“One of the provisions imposed by the Comelec is for them to conduct a periodic review…on the way these funds were spent. Nais lang namin i-remind ang local Comelec units na we were able to get an exemption sapagkat maaari itong i-revoke ng Comelec kung hindi sumunod ang ating mga LGUs dito  sa conditions,” he said. 

The Comelec earlier said an entire slate in Aklan and Bohol were facing disqualification cases for alleged vote-buying, vote-selling, and abuse of state resources.

Garcia confirmed that among those facing a disqualification case is former Aklan Governor Joeben Miraflores, who is running for Aklan Second District representative. 

Meanwhile, Rep. Camille Villar, who is running for senator in the midterm elections, also faced a show-cause order to explain alleged vote buying during a campaign sortie. 

Comelec said it has the power to suspend the proclamation of winning candidates in the midterm elections if they have pending disqualification cases regardless of grounds.

Garcia said this covers grounds arising from issues on the candidate’s campaign rallies and other election offenses.
