Kitty asks Supreme Court help to bring father Rodrigo Duterte back to PH

MANILA — Veronica "Kitty" Duterte on Wednesday asked the Supreme Court (SC) to compel the Philippine government to bring back her father former President Rodrigo Duterte, who was sent to The Hague, Netherlands to face the International Criminal Court (ICC).

Lawyers Salvador Paolo Panelo, Jr. and Salvador Panelo filed Kitty’s petition in the hope that Duterte could be brought back to the country while he was still in the custody of Philippine authorities.

“Umaasa kami na dahil iyong eroplano ay nasa kustodiya pa ng Pilipinas, ng gobyerno, umaasa kami na ‘pag inutusan sila ng Supreme Court na ibalik si Pangulong Duterte dito at iprisinta sa Supreme Court, kaya pa rin nilang gawin, kaya rin kami nagmamadali,” Panelo Jr. said.

Panelo Jr. noted that the Philippines was no longer a member of the Rome Statute and was no longer within the jurisdiction of the International Criminal Court.

“Ang mga grounds po natin para sa petition na ito ay unang-una hindi pwedeng maging batayan ng pag-aresto o pagdetina sa dating Pangulong Duterte ang ICC warrant of arrest dahil walang jurisdiction ang ICC sa ating bansa, kasi ang ICC pwede lang siya mag-exercise ng jurisdiction niya kapag ang national legal system ng bansa ay hindi umaandar,” Panelo Jr. said.

He added that there should have been an extradition process before Duterte was flown to The Hague.

“Kung sa extradition treaty nga, extradition, ibig sabihin may agreement ang dalawang bansa, na kapag may krimen na na-commit sa isang bansa pwedeng mag-request iyong kabilang bansa na i-extradite iyong tao na iyon sa kanilang bansa, pero kahit na merong treaty na ganon merong prosesong kailangang sundin,” the lawyer said.

Duterte was arrested after landing at the Ninoy Aquino International Airport (NAIA) from Hong Kong on Tuesday. 

He was whisked off on a chartered flight after over 12 hours of detention in the Villamor Air Base.

Duterte touched down in Dubai for a layover on Wednesday morning.
