House lawmaker: Impeachment of VP Sara not railroaded

MANILA – Vice President Sara Duterte’s impeachment at the House of Representatives last Wednesday was “not railroaded,” a lawmaker said on Saturday, adding the articles of impeachment were based on hearings  that the House held in recent months.

Duterte was impeached on Wednesday for "violation of the constitution, betrayal of public trust, graft and corruption, and other high crimes", with 215 House members endorsing the complaint.

Manila 3rd District Rep. Joel Chua, who has been tapped to serve as a prosecutor in the impeachment trial, said the process they followed was in line with the Constitution. 

“Yung mga laman nito ay nakita na natin. Ito ay dahil sa masusi na pag-conduct namin ng committee hearing… Kung ano ang laman o resulta ng committee hearing ay yun din naman ang laman nito... ang nauna ay threat sa buhay ng presidente — napanood naman natin yun, yun ang nadagdag,” said Chua.

(The contents of that are what we have already seen. That is because the committee hearings we conducted. What the committee hearings found is also what is in the articles of impeachment... the first article of impeachment is the threat to the President's life — we all saw that, and that is what was added)

Chua also told a news forum on Saturday that the Senate should convene immediately to begin trial.

The timing of the impeachment complaint so near the end of the 19th Congress has raised questions of how it would be treated by the 20th Congress. 

Bills that are not passed by a previous Congress need to be refiled and go through the legislative process again in the next one but an impeachment trial is a different proceeding altogether.

“Hindi na kailangan i-refile (ang impeachment). Kaya finile namin na last day – lahat naman yan, binalanse namin. Ang fear namin, kung yung tatlo (na impeachment complaint) ay dumaan pa sa Committee on Justice, baka hindi umabot sa time. Pagdating ng June 30 tapos na ang Kongreso,” he said.  

(There is no need to refile the impeachment complaint. We filed that on the last day, we wanted to balance things. Our fear was that the three impeachment complaints would need to go through the Committee on Justice and there might not be time. The 19th Congress ends on June 30)

He said that if the 19th Congress ends without the complaint being transmitted to the Senate, no impeachment proceedings could be initiated for another year.
