MANILA -- The Teachers Dignity Coalition (TDC) said Sunday it will file a petition in the Supreme Court questioning the legality of the allotted budget for the education sector for 2025.

According to the group, it might announce on Monday (January 6, 2025) when they will file the petition in the highest court.

"Mukhang nilabag ang saligang batas doon sa pag-allocate ng mas malaking budget sa DPWH instead of the education sector... By tomorrow pwede na naming sabihin kung kailan namin ipa-file sa Supreme Court 'yung petition para kuwestiyunin ang constitutionality nito," TDC National President Benjo Basas said in an interview with TeleRadyo Serbisyo's Story Outlook.

Basas said their petition aims to clarify and ask the court on how would the public interpret the education spending stated in the Constitution.

"Ang problema, para lang mahilot na mas malaki ang education sector budget, ang ginawa dito, isinama 'yung mga traditionally ay hindi naman talaga kabilang dito sa budget ng education," he said.

The allocated budget for the education sector has received ire from the public after budgets for non-DepEd, non-CHED, non-TESDA, or non-SUC programs were added.

These include the budgets for the Philippine Military Academy, Philippine National Police Academy, National Defense College, Local Government Academy, and the Philippine Public Safety College.

"Itong mga ito, previously, ay nasa kani-kanilang mga ahensiya 'yung budget like Department of National Defense, and Department of the Interior and Local Government pero ngayon isinama na ito along with DepEd, CHED, TESDA or SUCs natin. Kaya lumabas na mas malaki nga 'yung sa education sector at P1.05 trillion," Basas said.

"Sa aming paniwala, ang tinutukoy na education sector [sa saligang batas] ay 'yung mga nagbibigay talaga ng edukasyon lalo na sa mga bata. Kasi, of course, ang tinutukoy na mga teacher dun sa provision na 'yan ay hindi siguro 'yung mga nagtuturo para maging sundalo, mayor, o  pulis. Ito 'yung education na pwede nating sabihin na nasa basic education talaga," he added.
