Why did court order Neri Naig’s release? Are her legal woes over?

MANILA — Actress Neri Naig is not yet off the hook in her estafa and securities violations case despite a court’s order to release her from detention, a lawyer said Thursday. 

Roberto Labe, legal counsel of the complainants, said a Pasig court ordered Naig’s release after her lawyers argued that they had not received a copy of the complaint and were excluded from the preliminary investigation before she was arrested in late November. 

“Ito po ay constitutional right ng bawat akusado, kung saan sila ay dapat nakapag-participate sa level ng piskalya. Ayon sa mga documents na isinumite ng piskalya sa korte, wala nga hong patunay na sila ay nakatanggap ng complaint affidavit na ini-file namin sa kanila,” Labe told TeleRadyo Serbisyo. 

He said the court ordered a 60-day reinvestigation in which Naig could participate.

“Hindi po siya sa back to square one kasi kung makita po ninyo ang order, ang ibinasura lang naman ng judge ay ang warrant of arrest. Pero ang pag-issue po niya ng information ay nananatili po. Binigyan lang po ng 60 days reinvestigation,” he added. 

Naig was accused of persuading individuals to invest in a skin care company that is not authorized to solicit investments from the public, the Securities and Exchange Commission said.

She was detained at the Pasay City Jail on November 27 and was brought to the hospital last Friday for a medical evaluation. 

Naig's camp has denied the allegations, saying she was a "victim."

Her arraignment was set on January 9, 2025. 

Comedian Rufa Mae Quinto is fighting a securities violations case related to the same skin care company that Naig allegedly endorsed. 

The case against her was filed by a different set of complainants, Labe said.
