<div><br/></div><div><br/></div><p>MANILA — The Supreme Court reiterated that premarital sexual relations leading to pregnancy, as long as there are no other legal impediments, are not immoral and do not justify suspending an employee.</p><p>In a decision of the 1st Division, the court denied the petition for certiorari filed by Bohol Wisdom School, which suspended one of its unmarried grade school teachers, who got pregnant.</p><p>The court said that under the law, the standard of morality applicable to all is public and secular, not religious.</p><p>The court noted that BWS is a Christian school but it clarified that public and secular morality refer to conduct that is prohibited due to its harmful effects on human society and is not based on religious beliefs.</p><p>“Sexual intercourse between two consenting adults who have no legal impediment to marry, like respondent and her boyfriend, is not deemed as immoral,” the court said in the decision penned by Associate Justice Ricardo Rosario.</p><div><a href="https://www.abs-cbn.com/news/02/22/19/sc-teachers-pregnancy-out-of-wedlock-not-just-cause-for-dismissal">SC: Teacher&#x27;s pregnancy out of wedlock not &#x27;just cause&#x27; for dismissal</a></div><p>The court also upheld the penalties set by the Court of Appeals which ordered the school to pay the teacher her backwages, 13th month pay, attorney’s fees, and other benefits before November 9, 2016, her last day at work.</p><p>The school was also ordered to issue a Certificate of Employment to Mabao.</p><p>The Supreme Court also stressed in its decision that there is no law against sexual intercourse between two consenting adults as it does not contravene any provision in the Constitution.</p><p>“We thus find that respondent’s act of engaging in premarital sexual relations with her boyfriend and eventually getting pregnant, is not disgraceful or immoral withint the contemplation of the law,” the court said. </p><div><br/></div><div><strong>MORE STORIES:</strong></div><div><strong><br/></strong></div><div><strong></strong><a href="https://www.abs-cbn.com/news/2024/9/27/deped-doubles-teachers-vacation-service-credits-to-30-days-1050">DepEd doubles teachers&#x27; vacation service credits to 30 days</a><br/><a href="https://www.abs-cbn.com/news/nation/2024/12/13/angara-laments-slashed-deped-funds-in-2025-national-budget-1809">Angara laments slashed DepEd funds in 2025 national budget</a> <br/> </div><div><br style="caret-color:rgb(0, 0, 0);color:rgb(0, 0, 0)"/></div><div><strong><br/></strong></div>
