MANILA (UPDATED) — Marikina Mayor Marcelino "Marcy" Teodoro on Wednesday said he will question the Commission on Elections' decision to cancel his Certificate of Candidacy (COC).

This, after the Comelec ruled to cancel his COC for representative of the first district of Marikina City, citing material misrepresentation.

According to Teodoro, they have yet to receive a copy of the decision.

"We're still waiting for the decision, the resolution. Wala pa akong kopya… Pero at any rate we will file a motion for reconsideration. The decision of the division is not yet final naman," he also said.

Teodoro also said he has been living in the same address for a year, contrary to what Comelec said in its decision.

"We're in quandary. Bakit kinancel, there is no material representation naman… Ako'y residente naman ng address na yan. For a year, one year," he explained.

"The burden of proof lies kung sino nag allege. I was accepted as a registered voter of that district. It was accepted by Comelec," Teodoro added.

According to Teodoro, the Comelec accepted his voter registration in the district, so he finds it strange that they are now cancelling his COC.

"Ako tingin ko may mis-appreciation ang division. So it is still not final, it will go to the en banc, and it is not yet executory," he said.

"Pulitika ito eh," he added.

In a separate statement, Teodoro said there are hints of "political underpinnings" in the petitions filed against him.

"The fact that two petitions were filed against me shows that there are political underpinnings that is geared towards my removal from the electoral race. I will not allow this to happen and will exhaust all legal remedies available to me," Marcy said.

The mayor also reiterated that he is a true native of Marikina and is no stranger to the First District.

"Sa katunayan, ako ay naglingkod sa matagal na panahon bilang konsehal, congressman at kasalukuyang mayor ng lungsod ng Marikina," he said.

In its resolution promulgated on December 11, the Comelec First Division said Teodoro "deliberately committed material misrepresentation in his CoC" that he is eligible for the office he seeks to be elected to.

It granted the petition of Senator Aquilino Pimentel III who is running for the same position, among other petitioners. -- with a report from Adrian Ayalin, ABS-CBN News
