DOJ OKs trafficking, kidnapping raps vs 2 Chinese nationals over Porac POGO

MANILA — The Department of Justice (DOJ) has recommended the filing of Qualified Trafficking and Kidnapping for Ransom charges against two Chinese nationals over their involvement in the illegal POGO activities in Porac, Pampanga.

In a 14-page resolution, the DOJ panel of prosecutors said all the elements of the trafficking and kidnapping charges were present against Jiang Shi Guang and Qin Ren Guo.

The complaints cited the alleged torture of a Chinese victim who was tied to a bed frame and went out to seek help from authorities.

Another victim was found covered in bruises after allegedly being tortured with a baseball bat and was rescued after he was heard crying for help inside a locked room.

The panel said the narration of one of the complainants "would support the existence of threat, force, fraud and deception as the means of committing the acts of trafficking."

"Records would show that work or services were extracted from the complainant through a combination of intimidation or threat, including deprivation of freedom, abuse of authority or moral ascendancy, and debt-bondage, which is the very definition of forced labor and slavery," it added. 

One of the complainants was made to work as an online scammer in a "love scam" against his will. 

As for the Kidnapping and Serious Illegal Detention raps, the panel said the accused's defense that he was not in the POGO compound "is not sufficient to negate the positive identification made by the private complainant."

He also did not provide proof that it would be physically impossible from him to be at the scene of the kidnapping.

Meanwhile, the complaint for Kidnapping and Serious Illegal Detention against Jiang Shi Guang was dismissed. 

The panel said the deprivation of the liberty of one of the complainant was "merely incidental and non the primordial intent" of the perpetrators. 

Meantime, it also recommended the dismissal of the trafficking in persons, robbery and serious physical injuries raps against Qin Ren Guo. 

Last July, the Presidential Anti-Organized Crime Commission (PAOCC) and the Philippine National Police filed human trafficking, robbery, serious physical injuries, kidnapping and serious illegal detention complaints against the two. 

The complaint was submitted for resolution on July 31.

Both Chinese nationals remain under the custody of PAOCC after they were arrested during the raid at the POGO hub where Lucky South 99 was operating.
