Chiz: House approval of divorce bill leaves it open to question

MANILA — Senate President Francis Escudero on Thursday said the voting result of the House of Representatives when it approved the proposed absolute divorce law on final reading leaves room for those against the measure to assail its approval.

The House corrected the voting tally Thursday morning after the count Wednesday night caught the attention of critics who pointed out that it was not enough to approve the measure. 

Escudero said there should be a presumption of regularity. 

"Posibleng nagkamali but you have to understand always presume na regularly performed ang fucntions ng empleyado unless there is proof to the contrary. Pangalawa, parliamentary practice dictates. Natawa ako nung sinabi mong binago dahil di ko alam yun. Parliamentary practice dictates na galangin kung anuman ang pruseso  at ginagawa ng magkabilang Kamara," Escudero said.

"Pero maliwanag na 'yung mga anti-divorce, me pwedeng mapulutan at magamit na basehan para kuwestyunin ito," he said.

On Wednesday, the Absolute Divorce Bill got the final nod of the House of Representatives.

Under the measure, the grounds for absolute divorce include the same grounds for legal separation and annulment. But divorced spouses are given the right to remarry, unlike in legal separation.

As Senate chief, Escudero said he would not pressure his colleagues on the bill.

"Chance ng divorce dito? Ang position ko kaugnay ng divorce ay conscience at personal vote ito. Walang party, walang majority or minority stand dito.  Personal na desisyon base sa kani kanilang paniwala at relihiyon ang mangyayari diyan sa kada Senador at bilang tagapangulo ng Senado wala akong balak dumiin pabor o kontra dito," Escudero said. 

(It's up to each Senator. There will be no party stand or majority stand or minority stand. I don't plan to pressure anyone any way.)

Escudero prefers more accessible and affordable annulment proceedings. 

"Mas nais kong palawakin at gawing affordable at accessible yung annulment na nasa Family Code natin ngayon. Sa paanong paraan? Payagan ang PAO, tanggapin ang mga kasong tulad nito. Nagsabi na ang Supreme Court di na kailangan ng psychologist para mapatunayan ang psychological incapacity at pangatlo para mas maliwanag idefine ng Kongreso ano nga ba ang psychological incapacity menos away menos gulo menos debate dahil matagal naman na yang andiyan," he said.
