SC imposes up to 20 years of jail time for lascivious act on teenager

MANILA — The Supreme Court has imposed 14 to 20 years of imprisonment against an accused for acts of lasciviousness even if they complained of a disproportionate penalty to the crime committed.

In a decision of the 2nd Division, the court found the testimony of the 16-year-old victim to be "clear, candid, and categorical" when she testified that the accused lifted her skirt and touched her buttocks.

The court affirmed the conviction of the accused for lascivious conduct under the Special Protection of Children Against Abuse, Exploitation and Discrimination Act.

Aside from imprisonment, the accused was ordered to pay the complainant a total of P150,000 for civil indemnity, moral damages, and exemplary damages.

"The Court further noted that it is not unmindful of the accused’s claim that the penalty imposed is disproportionate to the crime committed and the surrounding circumstances of its commission," the court said in the decision penned by Associate Justice Antonio Kho, Jr.

“However, the Court stressed that it is duty bound to apply the law in full force and impose the proper penalty for the crime committed by the accused,” the court added.

The court said in a statement that it was recommending the case to the Palace for further study on the imposition of the severe penalty possible for acts of lasciviousness.
