Maria Tan, ABS-CBN News MANILA (UPDATED) -- Royina Garma, the former police official who implicated former President Rodrigo Duterte in alleged drug war killings, "should be on her way back" to the Philippines after she was blocked from entering the United States, an ambassador said Wednesday. 

Philippine Ambassador to the United States Jose Manuel "Babe" Romualdez confirmed that US authorities informed the Philippine consulate of Garma’s detention. Garma was set for immediate deportation, he said. 

Garma left the Philippines with her daughter on November 7 and was intercepted and taken into custody by the US immigration in San Francisco due to her canceled visa, the justice department said Tuesday. 

"Her visa cancellation is most likely due to the Magnitsky Act," said Romualdez.

The Magnitsky Act of 2016 is a law that allows the US government to ban the entry, freeze the assets and enforce other sanctions against foreign government officials involved in human rights offenses.

The US Embassy in Manila declined to provide any additional information on Garma's visa situation.

"We cannot comment on visa issues due to privacy concerns," said Glenda Wallace, Deputy Press Attaché of the US Embassy in the Philippines. 

Meanwhile, the NBI Organized and Transnational Crimes Division has issued another subpoena for retired police colonel Royina Garma. 

The subpoena was sent to her residence in Davao.

Garma was previously summoned by the NBI but she did not appear on the schedule of her subpoena last November 8. The NBI did not receive any notice from her that she would be flying out of the country.

The NBI is waiting for further instructions from the DOJ that is facilitating her return to the country. 

Garma has accused Duterte of organizing a national task force patterned after the "Davao model" to fund anti-narcotics operations and carry out a cash reward system for killing drug suspects. Duterte denied this. -- with a report from Niko Baua, ABS-CBN News
