The Elections chief made this statement, as he disclosed the commission's receipt of the Office of the Ombudsman's decision to perpetually disqualify Guo from holding public office.

"Basta bago matapos ang October 30 the Comelec will have a recommendation. Hindi lang sa kanya (Guo), kundi sa napakadaming natanggap kami na decision ng Ombudsman," Garcia said.

A candidate, he said, can be removed from position if one has been declared as a nuisance candidate; facing a complaint of misrepresentation, or ordered by the Ombudsman to be perpetually disqualified from holding public office.

"Ang pangatlo ang pinaka-crucial... sinabi namin, kikilalanin ng Commision on Elections ang desisyon ng Office of the Ombudsman. Kahit pa ito ay nakaapela sa mas mataas na hukuman, the Comelec can always implement and execute a decision of the Office of the Ombudsman," Garcia pointed out.

The Comelec is hearing similar cases involving officials in Cebu, Mandaue, Surigao and Mexico, Pampanga, Garcia said.

Those personalities, if they really have the intention to contest the decision to unseat or disqualify them, must be able to get a temporary restraining order from the Supreme Court before the Comelec starts printing ballots, the official stressed.
