Comelec reviews possible liabilities of St. Timothy Construction

The Commission on Elections is reviewing its contract with St. Timothy Construction Corporation (STCC), specifically on possible liabilities committed by the company, following its decision to withdraw from the Joint Venture (JV) contracted for the May 2025 elections. 

Comelec Chairman George Erwin Garcia issued the statement Friday, as an update on STCC's withdrawal from its Joint Venture with Miru Systems (Miru), Integrated Computer Systems, Inc. (ICS), and Center Point Solutions and Technologies, Inc. (CPSTI) for the automation of the May 2025 polls.

Garcia later released a copy of the Commission en Banc's eight-page resolution carrying their decision regarding St. Timothy's withdrawal.

"(The Commission) resolves to direct the Law Department to determine whether there is civil, criminal, and/or administrative liability on the part of St. Timothy Construction Corporation and/or the Joint Venture in general," the Comelec stated.

Garcia earlier disclosed the STCC's withdrawal due to a possible conflict of interest amid talks that company officials are planning to join the Pasig City elections and as a party-list organization. 

The Comelec immediately accepted the STCC's withdrawal and directed the two other Filipino companies involved in the JV with Miru, assume the obligations of STCC. 

One major Comelec requirement is for the Miru-ICS-CPSTI JV to submit an equivalent of the Net Financial Contracting Capacity (NFCC), which the STCC previously provided in the partnership. 

"As such, the remaining partners of the Joint Venture must submit its NFCC at least equal to the Contract Price or a committed Line of Credit from a Universal or Commercial Bank at least 10% of the Contract Price within 10 days from the receipt of this Resolution," Garcia, reading the Comelec resolution, said. 

In a statement, Miru assured the Philippine government of its commitment to ensure a steady elections next year. 

"We reiterate that this will not affect our commitment to delivering a better automated system in the service of Filipinos," Miru said.

Garcia meantime assured Filipino voters that STCC's withdrawal will have no effect in the May elections, especially when it comes to the voters' right to vote and seeing a credible and honest elections.
