Erin Tañada na may punto ang argumento ni Falcis.</p><p>&quot;Sa isyung ito maliwanag na kung literal o plain words ng Konstitusyon ang pagbabatayan natin, klaro na walang nakalagay na man at woman lang ang [maaaring] magpakasal,&quot; ani Tañada.</p><p>Paliwang niya, &quot;generic&quot; o walang kasarian ang mga ginamit na termino sa Saligang Batas.</p><div><em>Section 2. Marriage, as an inviolable social institution, is the foundation of the family and shall be protected by the State.</em> </div><p>Nalimitahan lamang ito sa Family Code kung saan tahasang tinukoy na babae at lalake o heterosexual couple lamang ang maaaring mag-isang dibdib.</p><div><strong>&#x27;KAMALIAN&#x27; SA PETISYON</strong></div><p>Isa sa mga nakikitang &quot;problema&quot; ni Tañada sa petisyon ni Falcis ay hindi umano siya ang nagkaroon ng &quot;injury&quot; dahil sa naturang batas.</p><p>&quot;Ang problema ng mga mahistrado sa kaniya [Falcis], may injury ba sa iyo? Ikaw ba ay nakapag-file ng marriage certificate before at hindi ka binigyan dahil ang [nais mong] asawa ay lalaki?&quot; </p><p>&quot;[Kasi] you can only go to court kapag may injury sa iyo. May karapatan kang na-violate. Sa civil union, puwede kayong magsama na parang may rights and obligations &#x27;yung dalawang panig sa isa&#x27;t isa,&quot; giit ni Tañada.</p><p>Sa ilalim ng civil union, magkakaroon na ng batas na mangangasiwa sa pag-aampon, paghahati ng ari-arian, at pagkakaroon ng karapatan sa partner sa oras ng sakit ang mga LGBT couple. </p><p>&quot;Kahit dito muna tayo.
