Dali grocery chain ordered to stop sale of suspected rip off products

MANILA -- Grocery chain Dali has been ordered to stop selling some of its products due to copyright infringement issues.

NutriAsia filed a complaint with the Intellectual Property Office of the Philippines (IPOPHL), accusing Dali of trademark infringement, unfair competition and copyright infringement.

This is because of some of its products called "Kulina Ketchup" and "Rajah Pura Vinegar" whose packaging are similar to Nutri Asia's UFC and Datu Puti products.    

IPOPHL issued an injunction against Dali following the complaint.

Speaking to TeleRadyo Serbisyo, IPOPHL Deputy Director General Atty. Nathaniel Arevalo said the complainant accused Dali of carrying products that had packaging similar to theirs.

“Ang trademark infringement hindi naman kasi kailangang gayang-gaya pero kung may pagkakahawig…na pwedeng magresulta sa confusion o kamalian o mistake ang public, pwedeng makaron ng trademark infringement,” he said.

He said the case is still being heard by the IPOPHL legal affairs office, adding that the preliminary injunction is only meant to protect the complainant from suffering irreparable injury “[before] the claims are thoroughly studied and adjudicated.”



The Department of Trade and Industry (DTI) earlier said it was actively investigating potential deceptive or unfair practices at Dali stores as part of its commitment to uphold consumer protection.            

Dali Everyday Grocery has 353 branches including 82 covered by DTI for carrying basic necessities and prime commodities.
